Welcome to KAGE wear. These Terms of Service ("Terms") govern your access to and use of kagewear.in (the "Site") and any purchase you make through it. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Account Terms

  • You must be at least 18 years old to create an account or place an order. If you are under 18, you may use the Site only with the involvement and consent of a parent or legal guardian.
  • You are responsible for maintaining the confidentiality of your account login details and for all activity under your account.
  • You agree to provide accurate, current, and complete information when creating an account or placing an order.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

2. Pricing and Payment

  • All prices on the Site are listed in Indian Rupees (INR) and are inclusive/exclusive of applicable taxes as indicated at checkout.
  • We reserve the right to change prices at any time without prior notice; the price charged will be the price displayed at the time you complete your order.
  • Payment must be made in full at the time of ordering through the payment methods available at checkout (including [PAYMENT METHODS, e.g. UPI, cards, net banking, Cash on Delivery]).
  • In the event of a pricing error on the Site, we reserve the right to cancel the order and issue a full refund.

3. Product Descriptions

  • Kagewear products are made to order using print-on-demand production. Colors, print placement, and fabric texture may vary slightly from what is shown on screen due to display settings, printing process, and fabric batch variation.
  • We make reasonable efforts to display product colors, sizing, and details accurately, but we do not warrant that product images are 100% free of minor variation.
  • Please refer to our size chart before ordering, as we are unable to guarantee fit.

4. Order Acceptance

  • Your order is an offer to purchase; it is not accepted until we confirm it via email/order confirmation.
  • We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, pricing errors, or unavailability of materials.
  • Because your product is printed specifically for you after you order, order changes or cancellations can only be accepted within 2-6 hours of placing your order, after which production begins and the order cannot be modified or cancelled.

5. Shipping and Delivery

  • Orders are processed and shipped in accordance with our [Shipping Policy], which forms part of these Terms.
  • Estimated delivery timelines are not guaranteed and may be affected by courier delays, weather, or circumstances beyond our control.
  • Risk of loss and title for products pass to you upon delivery to the shipping carrier.

6. Returns and Refunds

  • Returns, exchanges, and refunds are governed by our [Return and Refund Policy], which forms part of these Terms.
  • As our products are custom-printed to order, returns are limited to cases of damage, defect, or fulfillment error, as detailed in that policy.

7. Prohibited Uses

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable Indian law
  • Upload, submit, or request any design, image, or text that is obscene, defamatory, infringing on intellectual property rights, or otherwise unlawful (if custom/personalized products are offered)
  • Attempt to gain unauthorized access to our systems, other user accounts, or Site infrastructure
  • Use any automated system (bots, scrapers) to access the Site without our written permission
  • Engage in fraudulent transactions or chargebacks made in bad faith
  • Resell Kagewear products for commercial purposes without our written consent

We reserve the right to refuse service, cancel orders, and pursue legal remedies against users who violate this section.

8. Intellectual Property

All content on the Site, including logos, designs, product images, and text, is the property of Kagewear and protected under applicable Indian and international intellectual property law. You may not reproduce, distribute, or use our content without prior written permission.

9. Limitation of Liability

To the maximum extent permitted by law:

  • Kagewear's total liability for any claim arising from your use of the Site or purchase of a product shall not exceed the amount you paid for the product giving rise to the claim.
  • We are not liable for indirect, incidental, or consequential damages, including loss of profits or data, arising from your use of the Site or our products.
  • We are not liable for delays or failures in delivery caused by our shipping/fulfillment partners, courier services, natural disasters, or other events beyond our reasonable control.

Nothing in these Terms limits any right you have as a consumer under the Consumer Protection Act, 2019, that cannot lawfully be excluded.

10. Indemnification

You agree to indemnify and hold Kagewear, its officers, and affiliates harmless from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Site.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of [CITY], India.
